Welcome to Keto AI - Carb & Diet Tracker ("App"), a mobile application designed to assist users in tracking their dietary intake, managing carbohydrate consumption, and supporting ketogenic lifestyle goals. These Terms of Use ("Terms") govern your access to and use of the App, provided by Super Mobi Tools ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.


1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old or have the consent of a parent or legal guardian, and you agree to comply with these Terms. 3. App Features and Limitations


3.1 Functionality


The App allows you to track food intake, monitor carbohydrate and macronutrient consumption, set dietary goals, and receive AI-generated insights based on your input. Features may include barcode scanning, photo-based food recognition, and integration with third-party fitness trackers (e.g., Apple Health, Google Fit).


3.2 Accuracy Disclaimer


The App relies on user-entered data and third-party food databases, which may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of nutritional information provided. You should consult a qualified nutritionist or healthcare professional before making significant dietary changes.


3.3 Not Medical Advice


The App is not a substitute for professional medical advice, diagnosis, or treatment. The information provided is for general informational purposes only and should not be used to diagnose or treat any health condition. Always seek the advice of a healthcare professional for medical or nutritional guidance.


4. Data Privacy and Security


4.1 Data Collection


We collect personal information you provide, such as your name, email address, dietary preferences, and health-related data (e.g., weight, food logs, scanned meal images, macros, age, gender, goals), as outlined in our Privacy Policy.


4.2 Data Use

4.3 Data Security


We implement reasonable security measures to protect your data, including health data stored in Google Firebase, but no system is completely secure. The App displays advertisements via Google AdMob and Facebook Ads, which may collect personal data (e.g., device identifiers, location if enabled, ad interactions) to serve personalized or non-personalized ads. For users in the European Economic Area (EEA), United Kingdom, and Switzerland, we obtain your explicit consent for personalized ads, as required by GDPR, UK GDPR, the ePrivacy Directive, and the Swiss Federal Act on Data Protection (FADP). For users in California, Virginia, Colorado, Connecticut, and other US states with privacy laws, you may opt out of the sale or sharing of your personal data for targeted advertising via the App’s settings or your device’s ad preferences. 5. Intellectual Property


5.1 Ownership
The App, including its design, code, content, and trademarks, is owned by Super Mobi Tools or its licensors and is protected by intellectual property laws. You may not use our trademarks, logos, or content without prior written permission.


5.2 User Content
Any content you submit (e.g., food logs, custom recipes, meal images) remains your property, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content to provide the App’s services.


6. Third-Party Integrations and Services

The App may integrate with third-party services, such as fitness trackers (e.g., Apple Health, Google Fit) or food delivery platforms. We are not responsible for the accuracy, reliability, or privacy practices of these services. You should review their terms and privacy policies before using them.


7. Updates and Modifications

We may update or modify the App, including its features or content, at our discretion. Such updates may affect features accessed through subscriptions or one-time purchases. We are not obligated to maintain or support specific features, and access to the App may be discontinued at our discretion.


8. Termination

We may suspend or terminate your access to the App at our discretion, with or without notice, if you violate these Terms or for any other reason, including technical issues or discontinuation of the App. Upon termination, your account and data may be deleted, and you must cease using the App.


9. Limitation of Liability

To the fullest extent permitted by law, Super Mobi Tools, its affiliates, and its partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, health-related outcomes, or financial losses. The App is provided "as is" without warranties of any kind, express or implied.


10. Subscriptions and One-Time Purchases


Subscriptions
Users may access the App in the following ways:

  • Free Version: Provides limited access to features for an unlimited time.
  • Free Trial: Offers free access to all features for a limited time.
  • Paid Subscription “PREMIUM”: A subscription fee-based program providing access to extra content, such as advanced analytics, custom meal plans, and ad-free usage. You will only have access while your subscription is active. Subscriptions are purchased through the Apple App Store or Google Play Store and are subject to their payment policies, which may not provide refunds.
  • Monthly Subscription: Paid in monthly installments, automatically renewed until canceled. You must cancel before the next billing cycle to avoid charges. Refunds cannot be claimed for partial-month periods.
  • Yearly Subscription: Paid upfront with automatic annual renewals. You must cancel before renewal to avoid charges. Refunds cannot be claimed for partial periods.

One-Time Purchases
Users may access additional features or content through a One-Time Purchase, subject to:

  • Non-Refundable: Purchases are final unless required by law.
  • Reasonable Use: Access is valid as long as the App is operational and supported.
  • Platform-Specific Terms: Purchases through Apple App Store or Google Play Store are subject to their policies.
  • No Transfer: Purchases are tied to your account and non-transferable unless permitted by the platform.

11. Indemnification

You agree to indemnify and hold harmless Super Mobi Tools, its affiliates, and its partners from any claims, damages, or losses arising from your use of the App, violation of these Terms, or infringement of third-party rights.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association, except where prohibited by law.


13. Miscellaneous


13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Super Mobi Tools regarding the App.


13.2 Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions will continue to be valid.


13.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of such right or provision.


13.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at our discretion.
